The petitioner seeks bail in Jagdishpur P.S. case No. 297 of 2018 registered under Section 341, 323, 307, 504, 506, 34 of the Indian Penal Code. Later on Section 302 of the IPC was added after death of Pawan @ Tiger, a child aged about nine months.

The informant, Sadhan Mandal, named the petitioner and others and alleged that they came and assaulted the informant, his wife and Dhanjo Mandal, another brother of informant. The accused persons assaulted them with stick since the informant is issueless and his brother wanted that the informant should transfer the entire land in his name.

The learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.58676 of 2018 (2) dt.20-09-2018 2/2 informant or his wife did not get any grievous injury. The informant in his further statement disclosed that Jugo Mandal assaulted Pawan Kumar @ Tiger who was in the lap of his mother and Pawan Kumar sustained injury on his head. Later on Pawan Kumar died during the course of treatment. The petitioner is not the assailant of the deceased. The informant made specific allegation against Jugo Mandal that he assaulted Pawan Kumar. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. case No. 297 of 2018.
