2. The petitioner has prayed for bail in connection with Sahebganj P.S. Case No. 400 of 2025 registered for the offence punishable under Sections 317(2), 317(5), 313, 338, 336(3), 340(2) and 3(5) of the B.N.S.
3. The case of the prosecution is that three persons including the petitioner were caught by police during patrolling while they were riding a suspected stolen bike. On interrogation, they confessed that they have committed a theft of Rs. 2,16,000/- from Jagarnath Rai's house and have purchased items with the stolen money.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.75371 of 2025(2) dt.19-11-2025 2/2 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Save and except the confessional statement, there is nothing against him No recovery has been made. It has also been submitted that similarly situated co-accused, namely, Hariom Kumar has been granted bail by learned Co-ordinate Bench of this Court vide order dated 30.10.3025 passed in Cr. Misc. No. 72975 of 2025. the case of this petitioner stands on similar footing. He is in judicial custody since 18.07.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 2nd (West), Muzaffarpur in connection with Sahebganj P.S. Case No. 400 of 2025.
