JUSTICE SANJAY KUMAR ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner, who is in custody since 25.06.2018, seeks bail in connection with Jagdishpur P.S. Case No. 91 of 2018 (G.R. No. 766 of 2018) registered for offences punishable under sections 419, 420, 467, 468, 471/34 of the Indian Penal Code.

Informant is the Circle Officer, Jagdishpur, who in his written complaint addressed to the Officer-in-Charge, Jagdishpur, Bhagalpur, has stated that on the basis of seizure list dated 17.02.2018 by which recovery of two volumes of revenue receipts were recovered from the house of the petitioner. Same was verified and it was found that all the revenue receipts were

Patna High Court Cr.Misc. No.58741 of 2018 (2) dt.06-10-2018 2/3 forged and fake and on such allegation FIR was registered against the petitioner.

It has been submitted on behalf of the petitioner that signature of the accused person was not obtained on the seizure list and no copy of the seizure list has been handed over to him. It has been further submitted that the brother of this petitioner Vikash Sah @ Vikash Kumar, who is co-accused, has been allowed bail by one of the co-ordinate Bench of this Court in Cr. Misc. No. 39847 of 2018 on 11.07.2018. The case of the petitioner stands on similar footing to the case of co-accused who is on bail and so the petitioner also deserves bail. Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs.

10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Bhagalpur in connection with Jagdishpur P.S. Case No. 91 of 2018 (G.R. No. 766 of 2018), subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as
