1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 364, 307, 354(A) and 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. The learned counsel for the petitioner submits that the petitioner has antecedent of five cases. It is next submitted that petitioner stands acquitted in one case and is on bail in other four cases. It is further submitted that he has been falsely implicated in the present case by the informant.
4. It is also submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that while he had given Rs.200/- to Sunny

No.80712 of 2023(3) dt.07-03-2024 2/3 Kumar for purchasing fish, when he went to the market, he was caught by the petitioner, who dragged him from the motorcycle and assaulted him by bamboo and thereafter, when the informant arrived to rescue, Dilkhush Kumar assaulted him with lathi on leg, Aman Paswan assaulted by fists and slaps and Amar started pulling her sari and threatened that he would kidnap Sunny, but on alarm, the villagers arrived and the accused persons fled. It is next submitted that the present case has been instituted as a counter-blast of Annexure-2.

Learned A.P.P. opposes the anticipatory bail application and submits that though the injury is simple, but then, the petitioner carries antecedent of five cases and though a plea has been taken that present case is a counter-blast to Haweli Kharagpur P. S. Case No. 481 of 2023, but then, the said case was not instituted by this petitioner rather by one Anita Devi and the anticipatory bail application does not even remotely pleads that petitioner in any manner was related to Anita Devi.
6. Considering the submissions made by the learned Additional P. P., the Court is not inclined to extend the privilege of anticipatory bail application to the petitioner.
7. However, if the petitioner surrenders before the learned trial Court on or before 27.03.2024, in that event, the

No.80712 of 2023(3) dt.07-03-2024 3/3 learned trial Court shall dispose of the bail application of the petitioner on the same the day keeping in mind the fact that the allegations are general and omnibus in nature and the injury suffered by the injured is simply in nature.
8. Accordingly, the anticipatory bail application is thus rejected with the aforesaid observation. (Satyavrat Verma, J) vikash/- U T
