Mr. Akbar Ali ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 08-10-2018 I have heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 12 litres of foreign liquor and 1litres 800 Ml. of country-made liquor were recovered from the house of the petitioner. It is contended that nothing has been recovered from the conscious possession of the petitioner and he has been falsely implicated in the present case at the behest of his enemy. Petitioner claims that he is having clean antecedent and is in custody since 28.08.2018. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on

Patna High Court Cr.Misc. No.58814 of 2018(3) dt.08-10-2018 2/2 bail on his furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Kaimur at Bhabua, in connection with Case No. 762 of 2018 arising out of Ramgarh P.S. case No. 242 of 2018.

If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
