JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341,342,354B,354C/376/511 of the Indian Penal Code read with sections 4,6 and 8 of the POCSO Act.

Prosecution case is that all the FIR named accused persons including the petitioner tried to outrage modesty of informant's daughter.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Specific allegation of pulling her paint and attempting to commit sexual assault is against co-accused Lal Singh and petitioner can at best be said to be a member of unlawful assembly. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.494 of 2023(2) dt.24-03-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, POCSO Act, Darbhanga in Mahila Police Station Case No. 67 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
