The petitioner is in custody since 27.08.2018 in connection with Mojahidpur (Babbargunj) P.S. Case No. 182/2018 for the offence registered under Sections 30(a) of the Bihar Prohibition of Excise Act 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from his conscious possession but on suspicion, he has been taken into custody showing recovery of the wine. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on

Patna High Court Cr.Misc. No.59477 of 2018 (2) dt.28-09-2018 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Bhagalpur in connection with Mojahidpur (Babbargunj) P.S. Case No. 182 of 2018.
