Petitioner apprehends his arrest in connection with Obra P.S. Case No. 08 of 2018, G.R. No. 18 of 2018 for offences alleged under Sections 147, 149, 353, 307, 427, 332, 290, 283, 152, 504 of the Indian Penal Code.

The prosecution case, as lodged by the police personnel, is that death occurred at Obra market on account of accident, the public became violent and the police reached and tried to pacify the crowd. Large number of persons assaulted the police personnel and damaged police vehicle. 13 persons have been named in the F.I.R. along with the petitioner and 30-40 unnamed in the F.I.R.

No.60059 of 2018 (2) dt.08-10-2018 2/2 It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and allegation is general and omnibus and incident occurred on account of mob attack by the people of the locality. He submits that some of the co-accused named in the F.I.R. has been granted the privilege of anticipatory bail one being Cr. Misc. No. 16625 of 2018 dated 28.03.2018 by a coordinate Bench of this Court. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad in connection with Obra P.S. Case No. 08 of 2018, G.R. No. 18 of 2018, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
