====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(A), 38(i) and 41(1) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of liquor. However, petitioner was not apprehended at the time of recovery. Rather people informed that the petitioner and others had fled away. Petitioner has got identical criminal antecedent. Considering the criminal antecedent of the petitioner, I am not inclined to enlarge him on anticipatory bail in connection with Lakhisarai P.S. Case No. 245 of 2018 pending in the court of learned 2nd Additional Sessions Judge-cumSpecial Judge, Excise, Lakhisarai. Hence, prayer for anticipatory bail is refused.
