JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sessions Trial No. 495 of 2017 arising out of Nauhatta P.S. Case No. 47 of 2016 instituted for the offence under Section 302/34 of the Indian Penal Code. In the written report it is alleged that daughter of the informant was married with Jitendra Sao in the year 2010. He has no issue from his first marriage. Thereafter, he married with the petitioner. Both wife of Jitender Sao were living together. It is alleged that between both the wives there was some altercation. The daughter of the informant was done to death by petitioner and other accused persons. Petitioner has two children. Counsel for the petitioner submits that petitioner is in custody since 01.07.2016. She is lady. Counsel for the petitioner

Patna High Court Cr.Misc. No.59503 of 2018 (2) dt.06-10-2018 2/2 further submits that there is general and omnibus allegation against the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th A.D.J. Rohtas at Sasaram, in connection with Sessions Trial No. 495 of 2017 arising out of Nauhatta P.S. Case No. 47 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.

The petitioner will cooperate in conclusion of the trial. He will remain present on each and every date of trial till disposal of the case. He will not try to tamper with the evidence or intimidate the witnesses to delay the disposal of trial. In the event of default of two consecutive dates without valid reason, his bail bonds will liable to be cancelled.
