The petitioner seeks bail in a case instituted for the offence under Sections 379 and 304 of the Indian Penal Code. It is alleged in the written report that on 06.06.2018 she along with her husband and two daughters were travelling by Purvanchal express and when the train proceeded from Rampur Dumra Station, one person snatched her bag and fled away from the platform. Her husband also jumped from the train and scuffle took place between them. The husband of the informant told her to halt at Jasidih Station. The informant repeatedly tried to talk on the mobile of her husband but no conversation took place between them.

No.64498 of 2018 (2) dt.25-10-2018 2/2 It has been submitted on behalf of the petitioner that the petitioner has used his SIM Card No. 7488860460, which was issued in the name of Shobha Devi, who happens to be mother of the informant. The same sim was used in the snatched mobile as mentioned in the written report. Besides such allegation, there is no any allegation of overt act against the petitioner. The petitioner has clean antecedent. He is in custody since 15.06.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Railway Patna in connection with G.R.P. Rail Mokama (Hathidah) P.S. Case No. 28 of 2018. Both the bailers will be close relative of the petitioner.
