2. The petitioner seeks bail in connection with Bhaptiahi P.S. Case No. 127 of 2022 registered for the offence punishable under Section 376 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act.

3. The petitioner is said to have committed rape with the victim girl. The Medical evidence does not support the allegation of rape as such there is no any external or internal injury found upon the victim. The petitioner is in jail since 12.10.2022.

4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

5. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No. 80646 of 2023(3) dt.05-03-2024 2/2 of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VIth-cum-Special Judge, POCSO Act, Supaul in connection with Bhaptiyahi P.S.
