Petitioner seeks bail in connection with Special Case No. 8125 of 2017, arising out of Fatuha P.S. Case No. 509 of 2017 registered for the offence punishable under section 30(a) of the Bihar Prohibition of Excise Act, 2016. Learned counsel appearing for the petitioner submits that petitioner has falsely implicated in this case. Nothing illegal article or wine has been recovered from the conscious possession of the petitioner. He has no concern with the liquor in question. Petitioner has no criminal antecedent and is in custody since 13.08.2018.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the
Patna High Court Cr.Misc. No.61042 of 2018(2) dt.06-10-2018 2/2 petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Special Case No. 8125 of 2017, arising out of Fatuha P.S. Case No. 509 of 2017.
