====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 12-12-2024 Heard learned Counsel for the petitioners and learned APP for the State.
2. This application, for grant of anticipatory bail, arises out of Shakurabad P.S. Case No. 49 of 2024, disclosing offences punishable under Sections 341, 323, 308, 504, 506 and Section 34 of the Indian Penal Code.
3. The prosecution story, as per the First Information Report, is that on 26.03.2024, the son of the informant was standing in front of his house. In the meanwhile, petitioner no. 2 came and stood by the side of his son and started hot discussion with him and thereafter the petitioner no. 2 went to his house

No.81665 of 2024(2) dt.12-12-2024 2/3 and again came there along with the petitioner no. 1 and petitioner no. 3, having armed with iron rod, lathi and iron khanti and started assaulting the son of the informant, when the informant intervened, he was also assaulted by the petitioners on his head.
4. Learned Counsel for the petitioners submits that informant is next door neighbour of the petitioners and the dispute between them arose due to distribution of mutton. He further submits that a counter case has been lodged by the side of the petitioners against the informant bearing Shakurabad P.S. Case No. 50 of 2024. He next submits that the injuries caused to the informant and his son are simple in nature, evident from the injury report annexed at Annexure P/3.

Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are neigbours, having case and counter case and the injuries caused to the informant and his son are simple in nature, I am inclined to grant the privilege of anticipatory bail to the petitioners.
6. These applications are, accordingly, allowed.

Case No. 49 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
