Petitioner seeks bail in connection with Phulparas P.S. Case No. 178 of 2018 (G.R. No. 968 of 2018) registered for the offence punishable under sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner is not the owner of the vehicle in question. He was only the driver and he has no concern with liquor loaded in the vehicle. Petitioner has no criminal antecedent and is in custody since 11.07.2018.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.58282 of 2018(2) dt.28-09-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Madhubani-cum-Special Judge Excise Act, Madhubani in connection with Phulparas P.S. Case No. 178 of 2018 (G.R. No. 968 of 2018).
