JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 It has come under the heading 'To Be Mentioned' at the instance of learned counsel for the petitioners stating that in paragraph-2 at page-2 of the order dated 25.10.2019 it has inadvertently been mentioned that petitioner No.1 is lady though name of petitioner No.1 is Rajendra Mishra @ Rajendra Kumar Mishra and though prayer for petitioner No.2 is rejected while granting bail to petitioner No.1 but inadvertently it was typed just opposite.
Perused the order dated 25.10.2019 and perused the diary maintained by Court Master which shows that learned counsel for the petitioners is correct in his submission. As such para-2 of page No.2 of order dated 25.10.2019 stands recalled
Patna High Court CR. MISC. No.68625 of 2019(3) dt.15-11-2019 2/2 and it be read as follows :
So far petitioner No.1 is concerned, let petitioner No.1 in the event of arrest or surrender in the court below within a period of six weeks be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Muffasil P. S. Case No. 337 of 2019, subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that one of the bailors shall be a local person having sufficient immoveable property within the jurisdiction of court concerned. It is made clear that other part of the order shall remain intact.
Let this order be communicated to the court concerned forthwith.
