2. The petitioner seeks bail in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 569 of 2023 registered for the offence punishable under Sections 341/323/366/376/504/34 of the Indian Penal Code.

3. The petitioner is accused of kidnapping the victim girl and committing rape.

4. From the statement of the victim girl recorded under Section 164 of the Cr. P.C., it appears that it is a case of elopement and consensual sex. In paragraph No. 26 of the case diary, it has been stated that the petitioner has stayed with the the victim girl and the victim girl has now got married. The petitioner is in custody since 29.08.2023.

5. In view of the above, this application is allowed.

6. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Muzaffarpur in connection with Saraiya (Jaitpur O.P.) P.S. Case No. 569 of 2023.
