Petitioner prays for bail in connection with Babubarhi P.S.Case No. 210 of 2017 registered for the offence punishable under Section 302 of the Indian Penal Code.
Allegation as per FIR is that one unknown person brought a lady in unconscious position at the gate of hospital and he fled away.
Earlier prayer for bail of the petitioner was rejected vide order dated 14.5.2018 passed in Cr.Misc.No. 15660 of 2018. Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and petitioner is in custody since 7.10.2017 and two witnesses have been declared hostile as they have not supported the prosecution case.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VII, Madhubani, in connection with Sessions Trial No. 38 of 2018, arising out of Babubarhi P.S.Case No. 210 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
