JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 394, 411 and 307 of the Indian Penal Code and 27 of Arms Act.

Petitioner is not named in the first information report and it appears from perusal of impugned order as well as paragraph 12 of the petition that the name of this petitioner surfaced in course of investigation when co-villagers of the petitioner claimed to have seen the petitioner coming to his house on a motorcycle after the alleged occurrence. Furthermore, the impugned order reveals that one co-accused Suraj Sah @ Suraj Kumar Sah has already been granted

Patna High Court CR. MISC. No.69495 of 2019(2) dt.18-12-2019 2/2 privilege of bail by a co-ordinate Bench of this Court vide order dated 1.10.209 passed in Cr. Misc. No. 59264/2019. Petitioner does not have any criminal antecedents.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Katihar/concerned court in connection with Korha P.S. Case No. 238/2019.
