Petitioner seeks bail in Mojahidpur P.S. Case No.151 of 2018 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code as well as Sections 25(1-b)a, 26, 35, 27 of the Arms Act.

In the written report, it is alleged that the petitioner demanded Rangdari of rupees ten thousand from mobile and also made firing, but it did not hit anybody.

Counsel for the petitioner submits that he has been falsely implicated in this case. In fact, this petitioner was assaulted and he sustained injury for which he has filed case vide Mojahidpur P.S. Case No.154 of 2018. Instant case is counter blast to aforesaid case.

Patna High Court Cr.Misc. No.62579 of 2018 (2) dt.10-10-2018 2/2 Petitioner is in custody since 02.08.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Mojahidpur P.S. Case No.151 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
