JUSTICE SANJAY PRIYA ORAL ORDER 10-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Trial No. 2109 of 2018 arising out of Complaint Case No. 1319 of 2017 instituted for the offence under Sections 366, 387, 420, 376 and 120(B) of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is father of co-accused Lal Babu Paswan and father-in-law of the victim lady. In the complaint petition it is alleged that victim lady has been kidnapped by Lal Babu Paswan. Counsel for the petitioner further submits that prior to filing of instant complaint, the First Information Report was lodged vide Patahi P.S. Case No. 103 of 2017 by the petitioner against Pintu Mahto who had
Patna High Court Cr.Misc. No.62415 of 2018 (2) dt.10-10-2018 2/2 kidnapped the daughter of the informant namely, Punita Devi, for illegal purpose. The aforesaid First Information Report has been enclosed as Annexure-3.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-13, Motihari, East Champaran, in connection with Trial No. 2109 of 2018 arising out of Complaint Case No. 1319 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
