The sole petitioner, who is lady, apprehending her arrest in connection with Daraunda P.S. Case No. 200 of 2017 , registered for the offence under Section 272/273, 308 of the Indian Penal Code, 1860 and Section 30 (a) and 38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of her arrest or surrender. Learned counsel for the petitioner submits that petitioner has been arrayed as accused only on the ground that her husband was arrested while search was conducted in the house from where recovery of 10 liters of country made liquor was shown. It has been argued that save and except the fact that

Patna High Court Cr.Misc. No.61692 of 2018(2) dt.06-10-2018 2/2 petitioner is wife of one of the accused, there is no other material to connect the petitioner. Besides this, it has been argued that petitioner is having clean antecedent which fact has been stated in para - 3 of the petition.

Considering the facts and circumstances, in the event of her arrest or surrender within a period of six weeks from today, let the petitioner -Lalita Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum- Special Judge, Siwan / concerned court in connection with Daraunda P.S. Case No. 200 of 2017 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J) praful/- U T
