The petitioner seeks bail in Jamo Bazar P.S. Case No. 02/2018, instituted for the offence under Section 379 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is not named in the written report. He has been made accused in the instant case on the basis of recovery of motorcycle from his possession in Goreakothi P.S. Case No. 02/2018. From the report of D.T.O., it appears that aforesaid motorcycle is registered in the name of petitioner. Report of D.T.O. is annexed as Annexure-2. It is further submitted that petitioner was granted bail by a Coordinate Bench of this Court in Cr. Misc. No. 36334/2018
Patna High Court Cr.Misc. No.65621 of 2018 (2) dt.05-11-2018 2/2 dated 06.07.2018 in connection with Goreakothi P.S. Case No. 02/2018.
Petitioner is in custody since 27.03.2018.
Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate XIIIth, Siwan in connection with Jamo Bazar P.S. Case No. 02/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
