Petitioner, who is in custody, seeks bail in connection with Maniyari P.S. Case No. 76 of 2015 registered for the offences punishable under Section 272 and 273 of the Indian Penal Code and under Section 47(a) and 47(f) of Excise Act.
Allegation against petitioner is recovery of 19 bundle caps of wine bottles and 235 pieces of country made liquor containing 200 ml each from the house of the petitioner. It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Nothing has been recovered from the house of the petitioner. He is in custody since 01.09.2018.
Patna High Court Cr.Misc. No.62973 of 2018(2) dt.11-10-2018 2/2 Considering the nature of allegation against petitioner, I am not inclined to grant bail to the petitioner. Accordingly the prayer for bail is rejected at this stage. However, after three months of custody the petitioner shall be enlarged on bail by the court below on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise at Muzaffarpur in connection with Maniyari P.S. Case No. 76 of 2015.
Accordingly, this Criminal Miscellaneous is here by disposed of.
