The petitioner seeks bail in Mahua P.S. Case No.86 of 2018 registered under Sections 366(A) and 34 of the Indian Penal Code.
The informant alleged that Shyam Choudhary, his brother, Shekhar Choudhary and father, Rajesh Choudhary, the petitioner and Rakesh Kumar kidnapped his daughter for the purpose of marriage.
The learned counsel for the petitioner submits that petitioner is the father of Shyam Choudhary. Shyam Choudhary and the daughter of the informant were in love affairs with each other. Shyam Choudhary and the victim solemnized marriage and they are living together but the prayer for bail of the petitioner was
Patna High Court Cr.Misc. No.61564 of 2018 (2) dt.06-10-2018 rejected only on the ground that the petitioner could not produce the victim in Court.
Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is father of Shyam Choudhary who is alleged to have kidnapped the daughter of the informant and the daughter of the informant appears to be major on the date of occurrence according to Annexure-2, the school leaving certificate, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No.86 of 2018.
