ANJANA MISHRA ORAL ORDER 29-11-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor on behalf of the State. The petitioners are in custody since 14.09.2019, in connection with Singhiya P.S. Case No. 139 of 2019, for the offences under Sections 30(a) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioners submits that the alleged recoveries were not from the conscious possession of the petitioners but from the Car, which allegedly belongs to the petitioners. The petitioners were not aware of the presence of alleged illicit liquor. It is further submitted that the petitioners have no criminal antecedent.

No.75619 of 2019(3) dt.29-11-2019 2/2 Considering the aforementioned facts and circumstances and that the petitioners have no criminal antecedent, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II cum Special Judge Excise Act, Samastipur, in connection with Singhiya P.S. Case No. 139 of 2019.
