JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2018 The petitioner seeks regular bail in connection with Warisnagar P.S. Case No. 133/18, registered for offences punishable under Sections 147, 148, 149, 302, 307, 323, 324, 341, 447, 504 of the Indian Penal Code.

Allegation against the petitioner and large number of other accused persons is of assault to the deceased causing his death.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner and he has been in judicial custody since 18.07.2018, whereas, other co-accused of this case has already been enlarged on bail by this Court vide order dated 10.10.2018 passed in Cr. Misc.

Patna High Court Cr.Misc. No.65375 of 2018(2) dt.06-11-2018 2/2 No. 55080 of 2018.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for more than three months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Warisnagar P.S. Case No. 133/18, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
