JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2018 Heard the parties. The petitioner seeks regular bail in connection with Khagaria (Muffasil) P. S. Case No. 569 of 2016, registered for the offence under Sections 364, 307, 504/34 of the Indian Penal Code and 26/27 of the Arms Act.

Earlier prayer for bail of the petitioner has been rejected by a Co-ordinate Bench of this Court vide order dated 10.08.2018 passed in Cr. Misc. No. 46311 of 2018 on merit. Submission of the learned counsel for the petitioner is that he is in custody since 17.02.2018 and other co-accused has already been granted bail by different Co-ordinate Benches of this Court passed in different Criminal Miscellaneous cases. Heard learned A.P.P. who opposed the prayer for bail.

Patna High Court Cr.Misc. No.63629 of 2018 (2) dt.25-10-2018 2/2 Having heard both sides and considering the facts that similarly situated co-accused persons have been granted bail and bail of some person has been rejected, as such, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody since 17.02.2018, the trial Court is directed to expedite the trial and try to conclude the same as soon as possible. With the aforesaid observation, this application is dismissed.
