JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 The petitioner seeks regular bail in connection with Rajgir P.S. Case No. 70 of 2016, registered for offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. Prosecution case is that police on information of preparation of dacoity, raided the place of occurrence and arrested four persons and there is recovery of fire arms and they disclosed the name of petitioner.

It has been submitted on behalf of the petitioner that save and except confessional statement of co-accused, there is absolutely nothing against the petitioner and he has been in judicial custody since 13.08.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya -IV, Nalanda at Biharsharif, in connection with Rajgir P.S. Case No. 70 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
