The petitioner, who is in custody since 04.09.2019 and has clean antecedent, seeks bail in connection with Nokha P.S. Case No. 203 of 2018 dated 20.07.2018 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 216 litres of Indian made foreign liquor and 5 litres of locally brewed liquor is stated to have been recovered from an open field.

Learned counsel for the petitioner submits that the field does not belong to him and he has been made accused in this case because of the machination of local persons who have some axe to grind against him. Regard being had to the fact that the recovery

No.73044 of 2019(2) dt.04-12-2019 2/2 is from an open space and the period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge, Excise, Rohtas at Sasaram in connection with Nokha P.S. Case No. 203 of 2018.
