The petitioner, already in custody, seeks bail in connection with Beldaur P.S.Case No. 52 of 2018 registered under Sections 302 and 201/34 of the Indian Penal Code. Learned counsel for the petitioner appears to be correct in his submission that the case of the petitioner and co-accused Kailash Mistri is on similar footing, who has been granted regular bail by this Court by order dated 10.07.2018 passed in Cr. Misc. No. 40091 of 2018. He contends that suspicion is the only basis for implicating the present petitioner. Considering the above submission, this application is allowed.
