JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-04-2024 The present writ petition has been filed seeking the following reliefs:- "1(A). To direct the respondents to revise the Pay Scale of the petitioner @ Rs.5000/- 8000/- w.e.f. 09.08.1999 in view of the notification bearing notification no.4685 dated 25.06. 2003 issued by Finance Department, Bihar, Patna in place of Rs.3200/- 4900/- and, thereafter, to Pay the differences of salary alongwith 18% interest forthwith.

(B). To direct the respondents to further revise the Pay Scale of the petitioner @ Rs.9300/- 34800/- + 4600/- Grade Pay w.e.f. 01.01.2009 in view of the notification bearing notification No.7566 dated 14.07.2010 issued by the Finance

Patna High Court CWJC No.16625 of 2023(2) dt.22-04-2024 2/3 Department, Bihar, Patna in place of 5200/- 20200/-+ 2400/- Grade Pay and, thereafter, to Pay the differences of salary alongwith 18% interest.

Further, to direct the respondents to grant benefit of Third M.A.C.P. after completion of 30 years of service i.e. w.e.f. 2016 to the Petitioner in view of the aforementioned notification contained in Memo no.7566 dated 14.07.2010 issued by the Finance Department, Bihar, Patna, and to pay the consequential benefits of third M.A.C.P. with interest.

(D). To direct the respondents the revise pensionary benefits such as Pension and Gratuity to the Petitioner with interest in view of the aforementioned notifications dated 25.06.2003 and 14.07.2010 respectively."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Respondent No. 3, i.e. the Director-in-Chief, Health Department, Bihar, Patna, for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioner approaches the Respondent No. 3, by filing appropriate representation, within a period of two weeks from today, the same shall be

The present writ petition stands disposed off on the aforesaid terms.
