2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 115(2), 126(2), 109, 352, 3(5) of the BNSS and Section 27 of the Arms Act.

3. The case of the prosecution is that the petitioner fired at Md. Sami, which hit near his shoulder.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. It is also submitted that prior to this case, the case was filed by the side of the petitioner and from perusal of the

Patna High Court CR. MISC. No.80142 of 2024(5) dt.09-04-2025 2/2 injury report, it will transpire that the informant has received bullet injury near his shoulder. There is case and counter case between the parties. Only one fire injury was received and no attempt was made to make another fire. It is further submitted that the petitioner is languishing in judicial custody since 12.08.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Phulwaria P.S. Case No. 128 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai.
