The petitioner apprehends his arrest in connection with Khodawandpur P.S. Case No.307 of 2022 registered under Sections 420 and 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from conscious possession of the petitioner rather recovery has been made from a pick up van. The petitioner is neither the driver nor the owner of the alleged vehicle. The petitioner has got no criminal antecedent. Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the

Case No.307 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
