JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-05-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has prayed for bail in connection with Imadpur P.S. Case No. 34 of 2022 registered for the offence punishable under section 304 (B)/34 of the Indian Penal Code.
As per allegation in the FIR, petitioner along with his family members killed the daughter of informant on non fulfillment of dowry demand.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and he has falsely been implicated in the present case. Petitioner is father-in-law of the deceased and he has no concern with

There is no eye witness of the alleged occurrence. Moreover, the Petitioner is languishing in judicial custody since 24.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhojpur at Ara in connection with Imadpur P.S.
