The petitioner in the present case is seeking regular bail in connection with Phulwarisharif P.S. Case No.613 of 2018 registered for the offence punishable under Sections 399, 402 and 414 of the Indian Penal Code and Section 25(1-b) a/26/35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Learned counsel submits that there is no recovery from the conscious possession of this petitioner and his name has transpired in the confessional statement of the co-accused. Learned APP has opposed the prayer for bail.
Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.72087 of 2019(2) dt.04-12-2019 2/2 wherein this petitioner is said to be a member of the gang who had assembled with some vehicles and they were planning to commit crime and on the disclosure made by apprehended accused when raid was conducted at the house of petitioner a sum of Rs.2,10,000/- cash and one mobile set was recovered from his pocket, this petitioner has at least 10 cases on his head prior to this case, this Court is not inclined to grant regular bail to the petitioner. This application is dismissed.
