The petitioner is accused in connection with Sarsi P.S. Case No. 77 of 2010 registered under Section 414 of the Indian Penal Code.

The accusation is that on receiving the secret information about keeping a new Sumo Victa, on committing theft, in the campus of saw mill of Dimpu Jha in the village Sarsi by six persons named in the F.I.R. including the petitioner. The informant being the Officer-in-Charge of Sarsi Police Station went there and recovered the said vehicle in the campus of saw mill of Dimpu Jha. On removing the plastic cover from the aforesaid vehicle, registration no. WB-56E-9323 was found

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the name of the petitioner along with five others have come in the F.I.R. mere on suspicion, in fact, petitioner is accused in three other cases, as detailed in paragaraph 3 of the petition, in which, he is on bail, due to that reason police got implicated the petitioner in the present case and in the present case, he is in custody since 03.07.2018.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Purnea, in connection with Sarsi P.S. Case No. 77 of 2010. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
