The petitioner is accused in connection with Excise Case No. 147(o) of 2018 registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is that in course of patrolling duty, on Hyundai Santro car was intercepted and the driver and one other person sitting in the car started to flee away. While driver of the car was succeeded to flee away but another person apprehended, who disclosed his name as Dilip Kumar Pandey (petitioner). On search, 848 bottles each containing 180 ml Indian Made foreign liquor was recovered from the aforesaid Hyundai Santro car.

No.62467 of 2018(2) dt.08-10-2018 2/2 Learned counsel for the petitioner submits that petitioner had gone to his Sasural in the Village Naubatpur and in course of returning, he took the lift in the vehicle of Dinesh Kumar Pandey, who succeeded to flee away and he has no knowledge about keeping the illicit liquor in the aforesaid car. It is further submitted that petitioner has no criminal antecedent and is in custody since 15.09.2018.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.D.J.-II-cum-Special Judge (Excise), Buxar, in connection with Excise Case No. 147(o) of 2018.
