Petitioner prays for bail in connection with Ballia P.S.Case No. 189 of 2018 registered for the offences punishable under Sections 382, 414 and 34 of the Indian Penal Code. Allegation as per FIR is that informant while going to his village after withdrawing of Rs.40,000/- and when reached at Manish Cycle shop, Bhagatpur road, petitioner came and picked his bag containing the said amount and bank pass book and fled away on motorcycle and nearby persons apprehended him. Submission of learned counsel for the petitioner is that nothing is recovered from his possession and later on he has been remanded in this case and he is in custody since 6.7.2018. Heard learned APP also.
Patna High Court Cr.Misc. No.60731 of 2018 (2) dt.06-10-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage.
This application is, accordingly, dismissed.
