1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Sakri Police Station Case No. 92 of 2025, disclosing offences under Sections 126(2), 115(2), 117(2), 329(3), 109, 3(5) of the BNS, 2023.
3. As per the FIR, on 01.06.2025, in the evening, petitioners along with other accused persons arrived and assaulted the informant with lathi, danda, etc. When the son of the informant intervened, the accused persons assaulted his son

4. Learned counsel for the petitioners submits that petitioners no. 1 and 2 are husband and wife and they have been made accused due to land dispute between the parties. A piece of land was purchased by the informant from the brother of petitioner no. 1 and there was dispute regarding demarcation of the land. The injury caused to the son of the informant namely Sikandar Mandal is simple in nature and no other injuries are on record which would be evident from the impugned order itself.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are neighbours and the dispute between them is regarding demarcation of the purchased land, I am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Sakri Police Station Case No. 92 of 2025, subject to the condition laid down under Section 438
