Petitioner, who is in custody, seeks bail in connection with Madhepur P.S. Case No. 35 of 2018 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code and under Section 27 of the Arms Act. Allegation against petitioner is firing and committing loot of Rs. 12,23,00/- from the petrol pump of the informant.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. Nothing has been recovered from his possession. Name of the petitioner has surfaced in this case only on the basis of confessional statement of co-accused. He

Patna High Court Cr.Misc. No.67037 of 2018(2) dt.26-11-2018 2/2 has no criminal antecedent and he is in custody since 14.04.2018. It has been further submitted that similarly placed co-accused persons have been granted bail by the Court as well as another co-ordinate Bench of this Court in Cr. Misc. No. 52237 of 2018, 46075 of 2018, 42538 of 2018, 44377 of 2018, 55338 of 2018 vide order dated 27.09.2018, 14.08.2018, 30.07.2018, 04.09.2018 and 20.09.2018 respectively. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Jhanjharpur, Madubani in connection with Madhepur P.S. Case No. 35 of 2018.
