JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This is an application for grant of anticipatory bail in connection with Ghorasahan P.S. Case No. 318 of 2019, G.R. No. 1160/2019, disclosing offences under Sections 307/12B/34 of IPC and Section 27 of Arms Act.

As per F.I.R. there is allegation against the petitioner that he shot on the informant, causing fire arm injury. Submission of the learned counsel for the petitioner is that as a matter of fact, informant has taken rupees two lacs as a loan from the petitioner and when he demanded the same, he has falsely been implicated in this case. The injuries are not serious in nature.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that there is specific

Patna High Court CR. MISC. No.69223 of 2019(2) dt.14-11-2019 2/2 allegation against the petitioner of firing on the informant and injury report also there is allegation of fire arm injury. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender and pray for regular bail before the learned court below, the same shall be considered on its own merit.
