JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chorout (Choraut) P.S. Case No. 60 of 2019 registered for the offences punishable under Sections 147, 149, 341, 323, 324, 427, 307, 379, 504 and 506 of the Indian Penal Code.

As per FIR the accused persons, including the petitioner intercepted the vehicle of the informant and damaged the same and there is allegation of assault to the informant against other accused persons.

Submission of learned counsel for the petitioner is that FIR disclosed that there is no specific allegation of assault against the petitioner and he is only order-giver, having no criminal antecedent and as a matter of fact the vehicle of the informant damaged after dashing Thela of the petitioner, as such

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Pupri at Sitamarhi, in connection with Chorout (Choraut) P.S. Case No. 60 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
