The petitioner seeks bail in Piprakothi P.S.Case No.53 of 2018 registered for the offence under Sections 302 and 120B of Indian Penal Code.
Allegation is that on 14.04.2018 at 8 P.M. Alok Kumar who happened to be the son of the informant, having his Mobile No.6201141957 and 7033145548 with him left his house on his motor cycle towards Pipra Bazar but he could not return home till late night and next morning Father-in-Law of the elder son of the informant informed him that your son Alok Kumar had been murdered by strangulation by unknown person and his dead body was lying in the wheat field and his motor cycle also was parked
Patna High Court Cr.Misc. No.62828 of 2018 (2) dt.12-10-2018 2/2 and thereafter informant reached the place of occurrence. It has been submitted that petitioner is not named in the F.I.R.. He has been falsely implicated in this case merely on suspicion on the ground that the tower location of his mobiIe was active near the place of occurrence. He is in custody since 26.04.2018. Similarly situated co-accused person has been granted bail by a co-ordinate bench of this Court vide order dated 08.10.2018 in Criminal Miscellaneous No. 62437 of 2018. Having considered the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial MagistrateMotihari, Piprakothi P.S.Case No.53 of 2018.
