The petitioner is languishing in custody since 28.01.2019, though, it has wrongly been mentioned in the impugned order that the petitioner is languishing in custody since 28.10.2019, in a case registered for the offence punishable under Section 379 of the Indian Penal Code.
It is alleged that on theft of the motorcycle of the informant, FIR was lodged against unknown. During investigation the name of the petitioner sprang up. It is submitted by learned counsel for the petitioner that the petitioner has been remanded in the present case but he has not been named in the FIR and there is no recovery from the possession of the petitioner.
Patna High Court CR. MISC. No.70873 of 2019(2) dt.27-11-2019 2/2 Learned APP submits that the name of the petitioner sprang up during investigation.
Considering the fact that there is no recovery from the possession of the petitioner and investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. Case No. 271 of 2018.
