Petitioner, who is in custody, seeks bail in connection with Pirpainty P.S. Case No. 320 of 2017 registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Informant who is the father of the deceased has alleged that petitioner and other co-accused named in F.I.R. along with 2-3 unknown persons had called his son on 06.11.2017 at 6:00 P.M. for strolling in village and thereafter on 09.11.2017 his dead body was found in decomposed state. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case

Patna High Court Cr.Misc. No.63300 of 2018(2) dt.26-10-2018 2/2 on the basis of suspicion and dirty village politics. Except his own confession there is no incriminating material against him Deceased was traceless from 06.11.2017 but F.I.R. was instituted on 10.11.2017.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge, Bhagalpur, in connection with S.T. No. 485 of 2018 arising out of Pirpainty P.S. Case No. 320 of 2017 (G.R. No. 6037 of 2017).
