====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 08-10-2018 Heard Sri Babu Nandan Prasad, learned counsel for the petitioners.

Two petitioners, apprehending their arrest in connection with Karakat P.S. Case No. 143 of 2018 , registered for the offence under Section 30(a)/36 of the Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender.

At the very outset learned counsel for the petitioners by way of referring to the statement made in paragraph no. 3 of the petition submits that both the petitioners are having clean antecedent. He has also drawn my attention to the seizure list attached with the F.I.R. at page no. 16 to show that in the case recovery was made from a vacant field of one Ramta Singh

Patna High Court Cr.Misc. No.62759 of 2018(2) dt.08-10-2018 2/2 and petitioners only on suspicion as disclosed by the Chaukidar have been made accused.

Considering the fact that petitioners are having clean antecedent and nothing was recovered from premises or field of the petitioners, in the event of their arrest or surrender within a period of six weeks from today, let both the petitioners, namely

(1) Rajnish Kumar @ Rajnish Ram @ Gariba ; and (2) Purnmasi Kumar @ Niranjan @ Niranjan Kumar be enlarged on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge - II - cum- Special Judge, Excise, Rohtas at Sasaram / concerned court in connection with Karakat P.S. Case No. 143 of 2018 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure, 1973.
