JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Bathnaha P.S. Case No. 336 of 2018 registered for the offences punishable under Sections 364, 365, 366 and 34 of the Indian Penal Code.
As per FIR one co-accused Md. Haider has taken son of the informant to Punjab and later on he returned but his son did not return and so far these petitioners are concerned, there is allegation that they also conspired with Md. Haider in taking the son of the informant to Punjab and son of informant is still traceless and informant apprehends that his son was killed.
Patna High Court CR. MISC. No.69511 of 2019(2) dt.06-11-2019 2/2 Submission of learned counsel for the petitioners is that FIR itself shows that the allegation is against Md. Haider and petitioners being his family members have falsely been implicated in this case.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Bathnaha P.S. Case No. 336 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
