2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Paraiya P.S. Case no. 352 of 2023 instituted for the offence under Sections 387, 307, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per allegation in the FIR, informant has purchased a plot through registered sale deed dt. 14.3.2021 and he was constructing boundary wall. In the meantime, construction work was stopped by the petitioners and they
Patna High Court CR. MISC. No.79171 of 2024(4) dt.27-03-2025 2/3 demanded 3 bighas of land or ten lac rupees. It is further alleged that accused persons opened fire but luckily no one has received gunshot injury.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner nos. 2 and 3 are sons of petitioner no. 1 and the entire male members of the family has been falsely implicated in this case. Petitioners have got land possession certificate and are paying rent to the government of Bihar and rent receipt of the land for the year 2023-24 is annexed with the petition and the same is marked as AnnexureP4. Petitioners have tried to save their land and they have neither demanded any ransom nor opened fire upon anyone. Petitioners have bonafide claim over the said land
5. Learned APP appearing for the State has opposed the prayer of Bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Paraiya P.S. Case no. 352 of 2023, he will be

No.79171 of 2024(4) dt.27-03-2025 3/3 enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gaya subject to the conditions as laid down under section 438(2) of the Cr.P.C.
