The petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 27.10.2022.
Allegation is of kidnapping the granddaughter of the informant.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that petitioner and the victim were in love and thus they eloped. It is next submitted that petitioner and the
Patna High Court CR. MISC. No.826 of 2023(2) dt.29-04-2023 2/2 victim have already performed their marriage as specifically pleaded in para 10 of the bail application and out of the wedlock they have a child also.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the submission made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Palasi P.S. Case No. 245 of 2020.
